วิเคราะห์เปรียบเทียบสิทธิสัตว์ในมุมมองของพระพุทธศาสนากับกฎหมาย

Abstract

บทคัดย่อ

          บทความนี้ มีวัตถุประสงค์ 3 ประการ คือ 1) เพื่อศึกษาเเนวคิดและคำสอนว่าด้วยสัตว์ในพุทธศาสนาและกฎหมาย 2) เพื่อศึกษาแนวคิดทฤษฎีเรื่องสิทธิสัตว์และกฎหมายที่เกี่ยวข้อง และ 3) เพื่อวิเคราะห์เปรียบเทียบสิทธิสัตว์ในมุมมองของพระพุทธศาสนาและกฎหมาย เป็นการวิจัยเชิงเอกสาร ผลการวิจัย พบว่า 1) สัตว์ในทางพระพุทธศาสนา หมายถึงผู้ที่ยังเวียนว่ายตายเกิดในสังสารวัฏ โดยทั่วไปหมายถึงสัตว์ที่ไม่ใช่มนุษย์เป็นเดรัจฉาน มีร่างกายแนวขวาง บรรลุมรรคผลนิพพานไม่ได้ ส่วนในทางกฎหมาย หมายถึงสัตว์ที่มนุษย์เลี้ยงเพื่อการต่าง ๆ และสัตว์ที่อาศัยตามธรรมชาติ โดยภาพรวมถือเป็นทรัพย์สินและวัตถุแห่งสิทธิของมนุษย์ 2) คำว่า”สิทธิสัตว์”ไม่ปรากฏในคัมภีร์พระพุทธศาสนาแต่หลักคำสอนมีนัยแสดงถึงการมีสิทธิของสัตว์ หลักคำสอนที่เกี่ยวข้องคือหลักเบญจศีลและเบญจธรรม ในทางกฎหมาย “สิทธิสัตว์” คือเครื่องมือที่ถูกสร้างขึ้นเพื่อให้ความคุ้มครองและให้สวัสดิภาพแก่สัตว์ ทฤษฎีที่เกี่ยวข้องคือ ทฤษฎีสิทธิสัตว์ ทฤษฎีสวัสดิภาพสัตว์ ทฤษฎีการเลิกทาสสัตว์ และทฤษฎีสิทธิสัตว์บนฐานความเป็นพลเมือง 3) พุทธศาสนายอมรับการมีสิทธิทางธรรมชาติ สิทธิทางศีลธรรมของสัตว์ ส่วนสิทธิทางกฎหมายของสัตว์นั้น มนุษย์เป็นผู้มอบสิทธิให้ในภายหลัง โดยมีหลักเกณฑ์การตัดสินที่เสมือนเป็นตัวบทกฎหมายคือหลักศีล 5 และหลักกรรม โดยพิจารณาบนพื้นฐานของเจตนาและผลของการกระทำ สำหรับผู้ละเมิดย่อมได้รับโทษตามกฎแห่งกรรม ส่วนในทางกฎหมาย ยอมรับการมีสิทธิของสัตว์ทั้งสามข้อ จึงปรากฏเป็นบทบัญญัติและกฎหมายคุ้มครองสัตว์เพื่อปกป้องการถูกทำร้ายและการกระทำทารุณกรรมรวมถึงมีการจัดสวัสดิภาพให้สัตว์  ผู้ใดฝ่าฝืนก็จะถือว่าเป็นผู้กระทำผิดต่อสังคมและต้องได้รับการลงโทษตามกฎหมาย ตัวบทกฎหมายโดยทั่วไปพบว่าบัญญัติขึ้นตามลักษณะของแต่ละพื้นที่นั้น ๆ ทั้งนี้ ยังปรากฏปัญหา    ให้พบเห็นกันอยู่ โดยเฉพาะการทารุณกรรมและฆ่าสัตว์ให้ถึงแก่ชีวิต เนื่องมาจากปัญหาการรับรู้หรือเข้าใจ ผลประโยชน์ วิถีแห่งการเอาชีวิตรอด จิตสำนึกทางศีลธรรม และทัศนะที่แตกต่างกัน จึงเป็นประเด็นที่ถูกถกเถียงเพื่อหาทางออกร่วมกันและพัฒนาปรับเปลี่ยนให้เหมาะสมต่อไป

Abstract

          The objectives of this orticle had three aspects as 1) to study the concept of animal in Buddhist and laws, 2) to study of animal rights and the law that related to animals and 3) to analyze the animal rights in Buddhist and laws perspective. IT was a documentary research. The research’s result found that  1) in Buddhism, animal means being that reborn again and again in Samsara, in general term, it focuses on animal being, not human being, have transverse body and can’t achieving Nirvarana. In legal term, it means livestock for various purposes and animals living naturally, may be regarded as personal property .  2) The word “animal’s right” is not found directly in Buddhist text, but it implies the existence of animal’s right. Related teachings on this regard are Five Precepts and Five Dhammas. In the legal system, “animal right” means instrumental requirement designed for protect and offer a safeguard to animals. Related theories are Theory of animal’s right, theory of animal’s welfare, theory of animal’s slavery abolishment (Abolitionist Theory), and theory of animal’s right on the basis of civil (Citizenship-based Theory). 3) Buddhism accepts the existence of animal’s natural right and moral right. But in term of legal system, animal’s right was bestowed by human being afterward. Its justification taken as norm or rule are five precepts and the law of Kamma, considering on the basis of volition and the result of action. The one who violate will consume the result according to the action. Legal system accepts the existence of animal’s right in all three categories. In this regard, animal’s right can appears as a promulgation or law of protection animals to prevent them from cruel or brutal treatment as well as providing safeguard for them. The one who violate or ignore such order will be guilty and destined to be punished by law. The laws issued on this regard, are diverse according to locality and culture, therefore, the problems of brutality and killing animals are still be there due to the differentiation of acceptance and understanding, taking advantage or struggling for survival, moral conscience and opinion. These issues are waiting to be discussed and find the proper resolution together and develop them on the right path.
